General Terms and Conditions

These general terms and conditions apply to all appointments, treatments, gift cards, and credit vouchers of Harai relaxation massage and massage therapy.

Introduction

I believe it is important that a massage or treatment takes place in a clear, safe, and respectful setting. Clear agreements help with this. They protect both the client and the practitioner and clarify what we can expect from each other.

At the same time, not every situation is black and white. If there is an issue, I am happy to discuss it in a reasonable and respectful manner. Often, a suitable solution can be found through consultation. If that is not possible, the conditions below apply.

1. Definitions

In these terms and conditions, the following is understood to mean:

Harai: Harai relaxation massage and massage therapy.
Practitioner: the masseur or massage therapist who performs the appointment or treatment.
Client: the person who makes an appointment, undergoes a treatment, or uses a gift card or voucher.
Treatment: every massage, massage therapy session, intake, body-oriented guidance or related service provided by Harai is offered.
Appointment: the reserved time for a treatment.

2. Applicability

These terms and conditions apply to all appointments and treatments, unless otherwise agreed in writing or expressly in advance.

By making an appointment, the client declares to have read these terms and conditions and to agree to them.

3. Nature of the treatment

A massage or massage therapy treatment is not a substitute for a visit to a doctor, medical specialist, physiotherapist, psychologist, or other qualified healthcare provider.

The practitioner does not make medical diagnoses or provide medical advice. Explanations, advice, or observations by the practitioner are based on training, experience, and expertise as a masseur and massage therapist.

In case of doubt regarding symptoms, medical conditions, medication use, pregnancy, recovery after surgery, severe fatigue, fever, inflammation, infection, skin problems, thrombosis, cardiovascular disease, cancer treatment, or other relevant circumstances, the client must consult a doctor or qualified practitioner in advance.

In the event of acute, severe, unexplained, or worsening symptoms, the client should contact a doctor.

4. Client's duty to provide information

The client is responsible for fully and accurately informing the practitioner about relevant physical and psychological circumstances.

These include, among others:

  • medical conditions;
  • injuries;
  • operations;
  • pregnancy;
  • medication use;
  • infectious diseases;
  • skin problems;
  • allergies;
  • ongoing medical or therapeutic treatments;
  • limitations in posture, movement, or touch;
  • previous negative reactions to massage or bodywork.

The client must report changes in health, medication, or other relevant circumstances before each treatment.

Harai is not liable for damage resulting from the client providing incorrect, incomplete, or withheld information, unless caused by intent or gross negligence on the part of the practitioner.

5. Contraindications and refusal of treatment

The practitioner may decide not to perform, to modify, to interrupt, or to terminate a treatment when there are reasonable grounds for doing so.

These include, among others:

  • medical contraindications;
  • doubt about the safety of the treatment;
  • fever, infection or contagious disease;
  • insufficient hygiene;
  • transgressive behavior;
  • intoxication by alcohol or drugs;
  • threatening, disrespectful, or sexually suggestive remarks or requests;
  • circumstances in which the practitioner has insufficient expertise;
  • force majeure or practical impediment.

If Harai If an appointment is cancelled or rescheduled for reasons not attributable to the client, a new appointment will be made in consultation or any amount paid will be refunded.

6. Boundaries, consent and professional conduct

Treatment takes place within pre-discussed boundaries. The client may always indicate that the treatment needs to be adjusted, interrupted, or terminated. This may concern pressure, posture, touch, body area, temperature, clothing, silence, conversation, or other aspects of the session.

Treatment may be limited at any time at the client's direction.

Agreements made before or during the intake will not be extended during the same session. This is intended to maintain clear professional boundaries.

The practitioner adheres to the agreements made, unless he chooses to discontinue the treatment. If the practitioner discontinues the treatment without any inappropriate behavior by the client, no payment for that session is due.

In the event that the client oversteps professional boundaries, standards of conduct, or agreements made, the practitioner may terminate the treatment immediately. In that case, payment for the session remains due.

Erotic or sexual acts, comments, requests, or intentions are not part of the treatments of Harai and lead to termination or refusal of the appointment.

7. Hygiene

Both client and practitioner are expected to be well-groomed and clean.
The client is requested to use no or limited perfume.

In the event of insufficient hygiene, contagious diseases, skin infections, or other circumstances affecting the safety or suitability of the treatment, the practitioner may decide to modify, reschedule, or refuse the treatment.

8. Session duration and changeover time

Changeover time between treatments is necessary for rest, cleaning, changing materials, and preparation for the next client.

The indicated duration of a treatment is the total reserved time from arrival to departure, unless expressly agreed otherwise. Intake, changing, completion, and payment are included within this time.

The end time of the appointment is fixed and applies as the intended departure time. If the client arrives later than the agreed start time, this will reduce the duration of the session. In this case, there is no entitlement to a refund or discount.

9. Materials

The use of materials such as oil, linen, and other customary treatment materials is included in the price, unless stated otherwise in advance.

10. Rates and payment

The current rates are listed on the website or are announced prior to the appointment.
Payment is made immediately after the treatment, unless otherwise agreed in advance.
In the case of prepayment, the payment serves as a reservation of the appointment.

Harai reserves the right to accept appointments only on the basis of prepayment in the event of repeated cancellations, no-shows, or late payment.

11. Cancellation, rescheduling, and no-show

An appointment can be cancelled or rescheduled free of charge up to 24 hours before the agreed start time.
In the event of cancellation or rescheduling within 24 hours prior to the appointment, the full amount of the treatment may be charged.
In the event of a no-show without timely cancellation, the full amount of the treatment remains due.

If the appointment has already been paid for in advance, there is no automatic right to a refund in the event of cancellation within 24 hours or a no-show.
By mutual agreement, someone else may take over the appointment, provided this is reported in advance and the treatment can be performed appropriately and safely.

If Harai if the freed-up time can still reasonably be filled, costs may be waived in whole or in part, or a credit may be granted. This is determined on a case-by-case basis by Harai assessed.

12. Gift cards and credit vouchers

Gift cards and credit vouchers are valid for 2 years from the date of issue, unless a longer validity is stated on the card.

Gift cards and credit vouchers cannot be exchanged for cash.

In the event of loss, theft, or damage to a gift card or voucher, Harai not obliged to provide a replacement voucher, unless Harai can reasonably determine that the voucher is still valid and unused.

A gift card or voucher can be used for treatments of HaraiIf the rate of the chosen treatment is higher than the value of the voucher, the client pays the difference.

13. Results and responses to treatment

Treatments are aimed at supporting the well-being of the client. Harai However, cannot guarantee that a client will feel better after treatment or that symptoms will decrease.

After treatment, temporary reactions may occur, such as fatigue, muscle pain, emotional reaction, headache, or a change in the perception of symptoms.

The client remains responsible for monitoring their own health. In the event of new, persistent, serious, or worsening symptoms, the client must contact a doctor or other qualified healthcare provider.

Liability for normal, temporary reactions to a treatment is excluded to the extent permitted by law. This limitation does not apply in cases of intent or gross negligence on the part of the practitioner.

14. Liability

Harai performs treatments carefully and to the best of their ability.

Harai is not liable for damage caused by:

  • incorrect or incomplete information from the client;
  • failure to report relevant medical or personal circumstances;
  • failure to follow the advice to seek medical consultation;
  • normal reactions or after-effects of a treatment;
  • circumstances beyond the influence of Harai lie.

This limitation of liability applies to the extent permitted by law and does not apply in the event of intent or gross negligence on the part of the practitioner.

15. Privacy and confidentiality

Harai handles personal and health information confidentially.

Health data is processed only to the extent necessary for intake, treatment, safety, administration, and appropriate guidance of the client.

Harai does not share personal or identifiable health information with third parties without the client's consent, unless there is a legal obligation.

Anonymous discussions with fellow massage therapists or other therapists may take place with the aim of improving the quality of treatment. In doing so, no names or directly identifiable data are shared. If the discussion cannot take place sufficiently anonymously, permission will be requested in advance.

The client has the right to access, correction, and deletion of personal data to the extent permitted by law.

16. Complaints

If the client is dissatisfied with a treatment, communication, payment, or other course of events, the client is requested to discuss this with Harai.
Harai will attempt to resolve the complaint carefully and in consultation.
A complaint does not automatically suspend a payment obligation, unless Harai agrees with that.

17. Force Majeure

Harai is not obliged to fulfill an agreement when this is not reasonably possible due to force majeure.

Force majeure includes, among other things, illness of the practitioner, emergencies, government measures, technical malfunctions, severe traffic problems, extreme weather conditions, or other circumstances beyond the reasonable influence of Harai.

In the event of force majeure, a new appointment will be made in consultation, or any amount paid in advance will be refunded.

18. Amendment of terms and conditions

Harai may amend these general terms and conditions.

For appointments already made, the conditions applicable at the time the appointment was made apply, unless the change is for the client's benefit or is legally required.

19. Applicable law

On these terms and conditions and on all agreements with Harai Dutch law applies.
